3. DSC Industrial Supply and Road Rider Supply are located in North Kitsap Business Park in Seattle, Washington. Both firms are

owned by Paul and Suzanne Marshall. The Marshalls had outstanding commercial loans from Frontier Bank. The bank dispatched one of its employees, Suzette Gould, to North Kitsap to "spread Christmas cheer" to the Marshalls as an expression of appreciation for their business. Approaching the entry to Road Rider, Gould tripped over a concrete "wheel stop" and fell, suffering a broken arm and a dislocated elbow. The stop was not clearly visible, it had not been painted a contrasting color, and it was not marked with a sign. Gould had not been aware of the stop before she tripped over it. Is North Kitsap liable to Gould for negligence? Explain.

Answer:

Yes, North Kitsap Business Park is liable for negligence.

Explanation:

To understand this we first must describe what is negligence. Negligence happens when there is a failure of exercising proper care. The basis to punish someone of having a negligent attitude is that everybody should perform what is necessary to look after the other while doing an action.

In the case of the question, North Kitsap is liable because the accident of Gould happened before reaching the entry of Road Rider. And as a Business Park it is liable for the accidents caused due to the lack of care. The wheel stops should be painted and properly marked as the law requires.

I hope this answer helps you.

Mumz [18]

Answer:

In this sort of a case I would proceed to answer to him that I will help and go get him some clothes from my car to change his look. I would then proceed to announce the need of several 10-32s to the 20 of the house Code-2 response. I would then act as if I am trying to help him while the backup patrols are en route to assist. When the assistance arrives I would proceed to pull out a firearm of any sort from my holster ordering the friend to put his hands in the air and face away the officers performing a HRS.

Lois considers herself an act utilitarian. Accordingly, which of the following statements is Lois most likely to make?
Taya2010 [7]

Answer:

Correct Answer:

A. "It may be O.K. to violate someone’s rights if the good you produce outweighs the harm caused by the violation."

Explanation:

Utilitarian theory is a moral theory whereby an individual views the morality of an action being done as either good or bad based on the effect it would have. For example, is the dropping of bomb in an area in the cause of war.

This could be viewed by some people as morally right since it will kill people but at same time stop the ongoing war rather than a situation where the war continues on the long run.

satela [25.4K]
When improvements or buildings are added to real estate, the real estate tax assessment is usually increased to reflect the increased value of the property. Frank Partipilo and Elmer Hallman owned neighboring tracts of land. Hallman made improvements to his land, constructing a new building and driveway on the tract. The tax assessor made a mistake about the location of the boundary line between
Partipilo's and Hallman's land and thought the improvements were made on Partipilo' Instead of increasing the taxes on Hallman's assessor wrongly increased the taxes on Partipilo's
land. Partipilo paid the increased taxes for three years. When he learned why his taxes had been increased, he sued Hallman for the amount of the increase that Partipilo had been paying. Hallman raised the defense that he had not done anything wrong and that the mistake has been the fault of the tax assessor. Decide.
