Of course, critics came up saying that in this way the Supreme Court wouldn’t be against his New Deal, as it was before because them had unvalidated various important pieces of New Deal legislation justifying that the laws gave an unconstitutional amount of authority to the federal government. FDR proposed that every judge over 70 should retire and if they refused, an “subordinate” with complete voting rights was to be selected, in order to make sure that Roosevelt had a liberal majority. This was called by the opposites the “court-packing” plan.
