En la época de la Nueva España, cuando se establecieron las instituciones Españolas en territorios del Caribe y Latinoamérica, una de las instituciones más importantes que se estableció en estos territorios fue la llamada Real Audiencia.

Esta institución de carácter judicial fue la máxima autoridad en materia de a apelación penal en las entonces llamadas Indias, posteriormente, la Nueva España. Su jurisdicción era tanto civil como criminal en todo el territorio, y los encargados de ventilar los procesos judiciales en las Reales Audiencias fueron los Oidores.
