There are four situational factors that courts frequently require to establish a charge of disparate treatment.

Explanation:

Plaintiffs are the people who initiate the law suit. He desires to seek a judicial remedy and eh files a case.  Plaintiffs may sue employers who discriminate on the basis of race, color, gender, religion, or national origin. Employers who intentionally discriminate are clear evidences for a lawsuit.

The difference between disparate impact and disparate treatment is that disparate treatment is intentional discrimination, while disparate impact is unintentional.

Disparate treatment can be initiated on the employers on four factors they are: the person belongs to a minority class and they are ill treated based on the class aspect,  if the person applied for and was qualified for, a job but the employer was trying to fill without considering his selection, if the person was rejected despite being qualified and if the  position remained open and the employer continued to seek applicants as qualified by simply rejecting the qualified person.
