The murder commited was as an act of self defence, Tom was just trying to defend himslf while a person attempted to murder him.
Imagine a person trying to stab you with a knife. At that point please get that he was desperate to survive and i dont blame him for it. In the process of trying to escape he hit him with the head with a bottle,not with the intention to kill him but unfortunately for the.......... he did not survive.
